Terms & Contract
1. Definitions
1.1 'The Client' means the person who agrees to buy the service from Mike Sims.
1.2 'The Counsellor/Psychotherapist' means Dr Michael Sims.
1.3 'The Service' means the provision by Dr Michael Sims to the Client of the services as agreed between Mike Sims and the Client.
1.4 'The Therapy Session' means the period during which the Client employs Dr Michael Sims' services.
2 Price
2.1 The price shall be the discussed agreed price inclusive of VAT. It shall be calculated on an hourly rate sliding scale between £50 - £80 hr.
3 Payment
3.1 Payment shall be due at the start of each counselling session and if payment is not received Dr Michael Sims may terminate this agreement.
4 Appointments
4.1 In the event that the Client wishes to reschedule an appointment, the Client must give 48 hours notice to Dr Michael Sims and will be liable for payment of a cancellation fee for the missed appointment. The cancellation fee will be calculated at 50% of the agreed hourly rate. If the Client does not give 48 hours notice they will be liable to pay the full hourly agreed rate for the missed appointment.
5 Limitations of Liability
5.1 Dr Michael Sims shall not be liable for any consequential or indirect loss or loss of profit suffered by the Client in relation to the services supplied.
5.2 Dr Michael Sims' total liability to the Client for any default act or omission in connection with this agreement and the provision of the services shall be limited to the price paid for the counselling session.
5.3 Dr Michael Sims gives no guarantee that the counselling/psychotherapy and the provision of services will result in an improvement to the Client's mental or physical condition or general well being, as each individual client reacts in a different manner to counselling and it may be necessary for a client to undergo an extended period of counselling before any improvement may be apparent, if at all.
6 Confidentiality Warranty
Dr Michael Sims warrants to keep all information provided by the Client confidential save for clinical supervision and where Dr Michael Sims is required by law {or a strong moral obligation} to disclose some material facts and information to a third party.
7 Complaints Procedure
7.1 Dr Michael Sims is governed by the ethical and professional framework of the counsellor's professional body, The British Association of Counselling & Psychotherapy (BACP).
7.2 At the first instance, if the Client has any wish to complain they are asked to address their complaint to Dr Michael Sims who will endeavour to satisfy the Client.
7.3 If the Client is then not satisfied they are invited to contact the BACP:

8 Termination
8.1 Dr Michael Sims may terminate this agreement at any time by giving verbal or written notice to the Client.
8.2 The Client may terminate this agreement at any time by giving verbal or written notice to Dr Michael Sims.
8.3 Upon termination all outstanding fees shall become immediately due and payable.
